Terms of Service

01The deal

Welcome to MemeMuffin! These Terms of Service ("Terms") are the rules for playing our mobile games ("Games") and using mememuffin.com (together, the "Services"). MemeMuffin ("we", "us") is a digital studio that creates its own mobile games and publishes them on Google Play. Our Games are free to download and are funded by in-game ads and optional in-app purchases.

When you download, install or play a Game, or use our website, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Services. Some Games may have extra rules shown in the Game. Those rules form part of these Terms.

02Who can play

Our Games are made for players of all ages. If you're under the age of majority where you live, a parent or guardian must read and accept these Terms for you. They're responsible for how you use the Services, including any purchases.

Parents: Google Play lets you require approval for purchases (for example through Google Family Link or purchase authentication), and we recommend turning it on.

03Playing our games

When you download one of our Games, you get permission to install it and play it on devices you own or control. This permission is personal, for non-commercial use, can't be transferred to anyone else, and lasts as long as you follow these Terms and the app store's rules.

Downloading a Game doesn't transfer ownership of it to you. MemeMuffin owns the Games and everything in them: code, art, characters (including our muffin), music, sounds, names and logos. Any rights we don't expressly give you here stay with us.

04House rules

Keep it fun for everyone. You agree not to:

• cheat, or use bots, mods, hacks, exploits or unauthorised third-party software;
• copy, modify, decompile or reverse engineer the Games, except where the law allows it;
• interfere with ads, or create fake ad views, clicks or installs;
• sell, trade or transfer Virtual Items, progress or accounts for real money or outside the Game;
• harass others, or post offensive, hateful or illegal content where a Game allows player content;
• try to access our systems or other players' data without permission, or disrupt the Services;
• use the Services in a way that breaks the law or infringes anyone's rights.

If you find a bug, please tell us. We'd rather fix it than have it exploited.

05Virtual items & purchases

• What they are. Some Games offer virtual coins, gems, skins, boosters and other items ("Virtual Items"). You can earn them in the Game or buy them with real money. You can use them in that Game, but they aren't your property.
• No cash value. Virtual Items can't be exchanged for money or anything of real-world value. They're non-refundable except where the law or the app store's policy requires a refund.
• Changes. We may change prices, balance, or how and when Virtual Items are available. If a Game is retired, Virtual Items in it stop working (see Updates & downtime).
• Payments & refunds. Google Play (or the store you downloaded from) processes all payments under its own terms. Refund requests go through Google Play's refund process. If you paid but an item didn't arrive, email us your order ID (it starts with "GPA.") and we'll sort it out.
• Subscriptions. If a Game offers one, it renews automatically until you cancel it in Google Play under Payments & subscriptions. Uninstalling a Game doesn't cancel a subscription. Cancellation takes effect at the end of the current billing period.
• EU & UK withdrawal right. You normally have 14 days to withdraw from a digital purchase. When you buy digital content that's delivered immediately, you agree to immediate delivery and accept that you lose this right once delivery starts.
• Random rewards. If a Game offers randomised items (such as mystery boxes), we show the odds before you buy.

06Ads

Ads keep our Games free. They may be banners, full-screen ads or optional rewarded ads. Third parties provide the ads, and we don't endorse what they advertise. Anything you do with an advertiser is between you and them. You get a rewarded-ad bonus once the ad finishes, but an ad won't always be available. Your ad privacy choices are explained in our Privacy Policy.

We also promote our Games with ads on other platforms and through paid partnerships with content creators. Creators are independent: their content and opinions are their own. Any in-game reward or code they share is subject to these Terms.

07Your ideas & content

We love hearing from players. If you send us ideas, suggestions, memes or fan art, you keep ownership. You also give us permission to use, adapt and share them in our Services, worldwide and without time limit. We don't have to pay you for this, and you can still use your own work however you like. Please only send things you have the right to share.

If a Game lets you create names or other content, you're responsible for it, and we may remove it if it breaks these Terms.

08Our stuff & IP complaints

Our Games celebrate internet culture. Any nods to memes or pop culture are meant as parody, commentary or homage. If you believe something in our Services infringes your rights, email us with the subject "IP notice" and include:

• your name and contact details;
• the work you believe is infringed;
• where it appears in our Services;
• a statement that you believe in good faith that the use isn't authorised, and that your notice is accurate;
• your physical or electronic signature.

We'll review it promptly and remove or change the content where appropriate.

09Updates & downtime

We update our Games often with new levels, fixes and fresh memes. Some updates may be required before you can keep playing. We may change or remove features, or retire a Game entirely. If you hold unspent paid Virtual Items, we'll try to give you at least 30 days' notice before retiring a Game.

We can't promise the Services will always be available or free of errors. Progress saved only on your device may be lost if you uninstall the Game or switch devices. If you're a consumer in the EU or UK, we'll provide the updates the law requires to keep digital content working as described.

10Game over

You can stop using the Services at any time by uninstalling the Games. We may suspend or end your access if you seriously or repeatedly break these Terms, cheat or commit fraud, or if the law requires it. Sections that by their nature should survive, such as intellectual property, liability and disputes, remain in effect after termination.

11No promises

As far as the law allows, the Services are provided "as is" and "as available". We give no warranties, express or implied, including merchantability, fitness for a particular purpose or non-infringement. This doesn't affect consumer rights that can't legally be excluded.

12Liability

Nothing in these Terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that can't legally be limited.

Otherwise, as far as the law allows, we aren't liable for indirect, incidental, special or consequential losses, or for loss of profits, data (including game progress) or goodwill. Our total liability for any claim is limited to the greater of (a) what you paid us in the 6 months before the claim, or (b) USD 50.

If you're a consumer in the EU or UK, we're responsible for loss you suffer that's a foreseeable result of us breaking these Terms or failing to use reasonable care. We aren't responsible for loss that wasn't foreseeable.

13App store terms

Google Play

If you got a Game from Google Play, the Google Play Terms of Service and policies also apply. Google isn't responsible for our Games or our support.

Apple App Store (if we release there)

These Terms are between you and MemeMuffin, not Apple. Apple isn't responsible for the Game, its maintenance or support, or any claims about it. If a Game fails to meet any applicable warranty, you can notify Apple, and Apple may refund the purchase price. Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. You confirm that you aren't located in a country subject to a US government embargo and aren't on any US list of prohibited or restricted parties.

14Disputes

Let's talk first. Most problems can be solved with an email. Contact us and we'll try to resolve things informally within 30 days.

These Terms are governed by the laws of the country where MemeMuffin is established, without regard to conflict-of-law rules. If you're a consumer, you keep the protection of the mandatory laws of the country where you live, and you may bring claims in your local courts.

15Odds & ends

• Changes. We may update these Terms. If a change is significant, we'll tell you in the Game or on our website before it takes effect. If you keep playing after that, you accept the new Terms. If you don't agree, stop using the Services.
• Whole agreement. These Terms, the Privacy Policy and any in-game rules make up the whole agreement between you and us about the Services.
• Severability. If any part of these Terms is unenforceable, the rest still applies.
• No waiver. If we don't enforce a right straight away, we haven't given it up.
• Transfer. We may transfer these Terms as part of a reorganisation or sale of our business. You may not transfer your rights under them.
• Events outside our control. We aren't responsible for delays or failures caused by events beyond our reasonable control.
• Language. If we translate these Terms and the versions differ, the English version applies.
